Tennessee's legal fight against the prediction market platform Kalshi is now heading to the Sixth Circuit Court of Appeals, escalating a growing national debate over whether sports event contracts amount to illegal gambling. The state's attorney general argues that Kalshi is effectively operating sports betting by another name, sidestepping Tennessee's strict gambling laws. Kalshi allows users to trade contracts on outcomes like "Will the Chiefs win the Super Bowl?" which state officials say is indistinguishable from wagering on sports.
The case began when Tennessee regulators ordered Kalshi to stop offering such contracts in the state, claiming they violate a 2019 law that legalized sports betting only through licensed operators. Kalshi counters that its products are regulated commodity derivatives, not bets, and fall under federal oversight by the Commodity Futures Trading Commission. The company has already won a temporary reprieve in lower court, but the attorney general's appeal threatens to shut down its operations in Tennessee entirely.
Legal experts say the outcome could set a precedent for how other states treat prediction markets. If Tennessee wins, it may embolden other states to crack down on platforms like Kalshi, which has expanded rapidly by offering contracts on elections, weather, and sports. Kalshi maintains that its contracts provide valuable economic data and are no different from trading futures on corn or oil. The Sixth Circuit is expected to hear arguments in the coming months, with both sides digging in for a long fight over where the line between betting and investing actually falls.
